Two bills on Monday’s City Council meeting agenda are expected to be tabled to the June 29 meeting due to a valid protest petition for the rezoning application, which requires a supermajority (six votes) for passage plus at least two more members of the council present than the number required for passage, per a City Code provision (Sec. 2-57) providing that the council cannot consider amending a zoning district map for final passage unless at least two more members of the council are present than the number required for passage.
The companion annexation ordinance is also expected to be tabled.
Zone 3 Councilman Mike Schilling will be absent from the meeting. Zone 4 Councilman Matthew Simpson is expected to recuse himself from voting on both bills. The City’s policy regarding recusals is to treat the recusal as an absence.
Council Bill 2020-118 would annex about 10 acres of private property located at 851 W. Farm Road 183 (Plainview Road) at property owner Burning Tree Consulting LLC’s request.
Council Bill 2020-119 would rezone the property from County R-1 Suburban Residence District to R-LD Low Density Multi-Family 5 Residential District and establish Conditional Overlay District No. 183. The property owner intends to redevelop the property into a multi-family development at a density not exceeding 11 dwelling units per acre.
